1、导言
1. Introduction
1.1 本协议是用户（以下也称"您"）与燕加隆家居建材股份有限公司（以下也称"BMostChat"）之间的协议，BMostChat将严格依照本协议条款提供产品与/或服务。本协议条款构成您使用BMostChat所提供的产品与/或服务及其衍生服务之先决条件，您应当在仔细阅读、充分理解本协议后使用BMostChat的产品与/或服务，您使用BMostChat提供的产品与/或服务的行为（包括下载、安装、启动、浏览、注册、登录、使用等），都表示您同意本协议的全部条款；如果您不愿意接受本协议的任一条款，您应不使用或立即停止使用BMostChat提供的产品与/或服务。BMostChat的平台上出现的相关操作提示、答疑指南、使用帮助或BMostChat以其他方式向您展示的规则、流程等均构成您使用BMostChat的产品与/或服务的相关规则的一部分，与本协议具有同等效力。
1.2 在您接受本协议之后，本协议可能因国家政策、产品与/或服务以及履行本协议的环境发生变化而进行修改，修改后的协议发布在BMostChat平台的适当位置。如您在本协议更新后继续使用BMostChat的产品与/或服务，即表示您已充分阅读、理解并接受更新后的本协议并愿意接受更新后的本协议约束。
1.3 本协议所称"用户"，包括注册用户及未注册用户。凡未注册BMostChat的产品与/或服务的用户，自下载或安装BMostChat的产品与/或使用BMostChat的服务时即自动成为BMostChat的"非注册用户"，须遵循除本协议用户注册规定以外的其他所有条款。
1.4 本协议所称"BMostChat"，是指燕加隆家居建材股份有限公司开发、运营的语音通讯服务为主的富集型即时通讯软件。
1.5 BMostChat需要特别提醒您的是：由于BMostChat的产品和服务较多，为您提供的产品和服务内容也有所不同，本协议为BMostChat统一适用的一般性用户服务条款。针对BMostChat的某些特定产品/服务，BMostChat还将制定特定用户服务协议，以便更具体地向您阐明BMostChat的服务内容、服务规则等内容，您应在充分阅读并同意特定用户服务协议的全部内容后再使用该特定产品/服务。
1.6 如果您为未成年人，请在监护人的陪同下阅读本协议，并特别注意未成年人条款。未成年人行使和履行本协议下的权利和义务视为已获得了监护人的认可。
1.7 BMostChat在此善意地提醒您，本协议中与您的权益（可能）存在重大关系的条款，BMostChat已采用加粗字体来特别提醒您，请您留意重点查阅。同时，双方同意前述条款不属于《中华人民共和国民法典》第四百九十七条规定的"不合理地免除或者减轻其责任、加重对方责任、限制对方主要权利......排除对方主要权利"的条款，即您和BMostChat均认可前述条款的合法性及有效性，您不会以BMostChat未尽到合理提示等义务为由而声称协议中全部或部分条款非法或无效。
1.8 如您在阅读本协议过程中有任何疑惑或其他相关事宜，BMostChat为您提供了多种反馈渠道，详见"13、联系方式"，BMostChat会尽快为您作出解答。
This Agreement is between the user (hereinafter referred to as "You") and the BMostChat application. (hereinafter referred to as "BMostChat"), regarding the use and services of the BMostChat developed and operated by Yakalon, Inc. BMostChat will strictly provide products and services in accordance with the terms of this Agreement. The terms of this Agreement constitute a prerequisite for your use of the products and/or services provided by BMostChat and its derivative services. You must carefully read and fully understand this Agreement before using the products and/or services provided by Yekalon your use of the products and/or services provided by BMostChat (including but not limited to download, installation, start, browsing, registration, log in, use, etc.) signifies your consent to all the terms of this Agreement. If you are unwilling to accept any of the terms of this Agreement, you must not use or immediately cease to use the products and services provided by BMostChat. The relevant operation prompts, Q&A guides, usage assistance, or rules and processes displayed to you on BMostChat constitute a part of the relevant rules for your use of such Application, and have the equal legal effects as this Agreement.
Despite your acceptance, this Agreement may still be subject to modifications due to unforeseen circumstances, e.g., changes in government policies, conditions and environment in which the products and services had been offered. The modified Agreement will be published on the BMostChat in a noticeable fashion. If you continue to use the BMostChat and/or its services after the modifications of this Agreement, it will be construed as that you have fully read, understood, and accepted the modified agreement and are willing to be bound by this Agreement.
The term "user" as used in this Agreement includes both registered and non-registered users. A BMostChat user without signing into any account is a "non-registered user", and therefore bound by all terms of this Agreement, except for the provisions specific to registered users.
The "BMostChat" referred to in this Agreement refers to a feature-rich instant messaging application, primarily offering voice communication services, which is developed and operated by YEKALON INDUSTRY INC.
Due to the large number of products and services provided on BMostChat APP, the content of the products and services provided may vary person to person. This Agreement serves as a general guideline between You and BMostChat. For certain specific products/services offered on BMostChat, please refer to the corresponding service agreements for details.
If You are not of the age of majority in your jurisdiction, please read this Agreement with your guardian and pay special attention to the Minor's Terms. Your activities on BMostChat will be regarded as being consented by your guardian.
BMostChat hereby reminds you in good faith that clauses which may have significant impact on your rights and interests have been highlighted in bold font for your special attention. Please review them carefully. Both parties expressly agree that the aforementioned clauses do not fall under the provisions of Article 497 of the Civil Code of the People's Republic of China governing "unreasonable exemption or reduction of liability, aggravation of counterparty obligations, restriction of counterparty's fundamental rights... or exclusion of counterparty's fundamental rights." You therefore acknowledge the legality and validity of these clauses and agree not to challenge the legality or validity of any part of this Agreement on the grounds of BMostChat's failure to provide reasonable notice.

2、服务说明
2. Service Descriptions
2.1 本协议适用于BMostChat向用户提供的所有产品与/或服务，包括但不限于：
- 2.1.1 bmostchat.com以及其他任何由BMostChat直接所有或运营的任何网站（也称"BMostChat网站"）；
- 2.1.2 BMostChat直接拥有或运营的客户端产品，包括但不限于平板、手机、电脑等现有及未来的全部终端（也称"BMostChat客户端"）；
- 2.1.3 BMostChat提供的其他产品和/或服务（含站外服务，例如：BMostChat广告服务和"通过BMostChat的服务申请或分享"的插件等）。
（以上产品、服务统称为"BMostChat的产品与/或服务"，上述产品、服务所在的平台统称"BMostChat平台"）
2.2 BMostChat的产品与/或服务，均仅限于用户在BMostChat平台使用，任何以恶意破解等非法手段将BMostChat的产品与/或服务与BMostChat平台分离的行为，均不属于本协议中约定的BMostChat的产品与服务。由此引起的一切法律后果由行为人负责，BMostChat将依法追究行为人的法律责任。
2.3 BMostChat官方公布的方式为下载、安装、启动、浏览、注册、登录、使用BMostChat服务的唯一合法方式，用户通过其他任何未经BMostChat合法授权的渠道、途径、方式获取的BMostChat的产品与服务（包括且不限于账号、客户端下载等服务）均为非法取得，BMostChat概不承认其效力，且一经发现BMostChat有权立即做出删除、取消、清零、封号等处理，任何因此导致的一切不利后果均由用户自行承担。
2.4 用户有权在BMostChat授权的范围内使用其合法获得的BMostChat账号等，但是用户确认其仅享有上述服务和产品的使用权，上述服务和产品及其衍生物的所有权及知识产权均归BMostChat所有或拥有合法授权（但是经合法渠道取得的实体产品所有权以及账号下归属于用户的个人财产、BMostChat另有说明的其他权益除外）。BMostChat有权在法律允许的最大范围内根据实际情况自行决定收回上述使用权而无需通知用户，亦无需征得用户同意。
2.5 BMostChat有权提前向用户公告（包括但不限于弹出页面公告、BMostChat官方网站公告）以修改、替换、升级与BMostChat提供的任何产品与/或服务和/或上述产品与/或服务相关的软件。如果用户不同意BMostChat提供的任何产品与/或服务和/或上述产品与/或服务相关软件的修改、替换、升级，请直接拒绝、停止、取消使用，否则视为用户同意BMostChat提供的任何产品与/或服务和/或上述相关软件的修改、替代、升级，同时前述修改、替换、升级不影响本协议的效力。
The products and services provided by BMostChat, includes but not limited to:
- www.bmostchat.com and any other websites directly owned or operated by BMostChat (also known as the "BMostChat Websites");
- BMostChat directly owns or operates client products, including but not limited to all existing and future terminals such as tablets, mobile phones, and computers (also referred to as the "BMostChat Client")
- Other products and/or services provided by BMostChat (including off-site services, such as BMostChat advertising services and plugins for "applying or sharing through BMostChat services," etc.)
This Agreement applies to all products and services, including but not limited to the app, websites and other services (e.g., BMostChat Advertisement services, or sharing/application via BMostChat Plugins).
BMostChat limits the use of its products and services on BMostChat Platforms only. Any unauthorized attempt to sever BMostChat's products and services from BMostChat Platforms (e.g., malicious cracking) is illegal, and therefore not governed by this Agreement. BMostChat does not take responsibility for any consequences arising from such wrongdoing, and reserves all its rights to pursue legal actions against such actors.
If You download, install, start up, browse, sign up, log in BMostChat via unauthorized third party and use its products and services, BMostChat does not guarantee its Client App's functionality, nor acknowledge any of your activities thereon. BMostChat reserves all rights to take further actions to delete, cancel, reset, or ban your activities, and shall not be liable for any losses or damages incurred as a result.
You have the right to use the legally obtained BMostChat account within the scope authorized and use its products and services. You also acknowledge that the ownership and intellectual property rights of the aforementioned products, services, and their derivatives belong to BMostChat or are legally authorized by the proper rights-holders (except for the ownership of physical products obtained through legal channels, personal property belonging to users under the account, and other rights and interests specified by BMostChat). BMostChat reserves the right to revoke the aforementioned right of use to the maximum extent permitted by applicable laws without notifying You, or obtaining your consent.
BMostChat will announce in advance (including but not limited to pop-up on web page, announcements on www.bmostchat.com, etc.) to modify, replace, and upgrade any products and services provided by the app, the people and software related to the aforementioned products and services. If You do not agree to any such modification, replacement, or upgrade, please directly refuse, stop, or cancel. Otherwise, it shall be regarded that You agree to the modification, replacement, or upgrade of any products and services provided by BMostChat, the people and software related to the aforementioned products and services, and the aforementioned modification, replacement, or upgrade shall not affect the validity of this agreement.
3、服务使用规则
3. Service Rules
3.1 用户在申请注册使用BMostChat产品与/服务时，必须向BMostChat提供完整、真实、准确、合法、有效、最新的个人资料。如果上述信息发生变化，用户应及时更改，并保证上述资料是用户本人的真实资料。用户不得冒用他人身份或使用他人邮箱、手机号码等注册BMostChat账号。如果因注册信息不真实或更新不及时或冒用行为等导致的账号纠纷或引发的相关问题，BMostChat不负任何责任。同时，BMostChat有权选择根据实际情况暂时或永久封停此账号。
3.2 用户仅可自行在BMostChat的官方渠道注册成为BMostChat注册用户。任何通过其他非BMostChat官方途径获得的BMostChat账号信息（包括但不限于购买、租用、借用、分享等方式获得的BMostChat账号信息，以及恶意利用或破坏BMostChat注册系统获得的注册账号），BMostChat不保证其合法性和正常使用，由此导致账号被封停、注销或收回的，用户自行承担全部责任。
3.3 用户应当通过真实身份信息认证注册账号，且用户提交的账号名称、头像和简介等注册信息中不得出现违法和不良信息，BMostChat有权对上述信息及用户的真实身份予以审查，如存在上述情况，BMostChat有权不予注册，或其账号头像、简介等注册信息存在违法和不良信息的，BMostChat有权不经通知单方采取限期改正、清除、临时封停、永久封停、注销登记、收回等措施。
3.4 用户不得通过任何手段恶意注册BMostChat账号（包括但不限于使用无效未验证邮箱、无效手机号、使用他人身份等恶意注册方式）或利用BMostChat账号进行违法活动、侵害、骚扰、欺骗其他用户以及其他违反本协议的行为。若有上述情形，BMostChat有权对上述账号采取永久封停、注销登记、收回等措施，由此造成任何损失，由用户自行承担。同时，BMostChat有权将上述行为移交有关部门处理。
3.5 BMostChat账号所有权归BMostChat所有，用户仅拥有BMostChat账号的有限使用权。用户需对其享有使用权的账号下所从事的所有行为承担责任，用户应妥善保管自己的账号、密码，不得将BMostChat账号转让、出借、出租、售卖或分享予他人使用。否则BMostChat有权选择根据实际情况暂时或永久封停此账号，当用户的账号或密码遭到未经授权的使用时，用户应立即通知BMostChat，否则未经授权的使用行为均视为用户本人的行为。BMostChat为了保障用户的账号安全可能会定期或不定期采用不同的方式对用户的身份进行验证，包括但不限于要求输入验证码、短消息验证、邮箱认证等。如用户无法完成验证或拒绝验证的，BMostChat可合理怀疑用户的账号出现异常或被盗，并暂停向用户提供产品与/或服务及/或采取进一步措施。
3.6 因非BMostChat原因导致的用户账号信息遗失，用户如需找回的，需按照BMostChat官方公布的账号找回流程的要求提供相应的信息和证明，并确保提供的信息和证明文件的合法、真实、有效，若提供的材料不真实或不符合要求，无法通过BMostChat账号的安全验证，则可能会导致账号找回失败，相应的风险和损失由用户自行承担。
3.7 为保障BMostChat为更多的用户提供更优质的服务，用户同意BMostChat有权对连续六个月未使用的BMostChat账号，通过非法方式获取BMostChat账号和违反本用户协议的BMostChat账号进行永久封停、注销登记或收回。
3.8 用户同意BMostChat在提供产品与/或服务的过程中以各种方式投放商业性广告或其他任何类型的商业信息（包括但不限于在BMostChat平台的任何位置上投放广告，在用户上传、传播的内容中投放广告），用户同意BMostChat在取得用户同意后通过电子邮件或其他方式向用户发送商品/服务促销或其他相关商业信息。
3.9 用户知悉并同意，受限于宽带和网络连接问题，BMostChat在提供产品与服务的过程中可能会出现需较长时间缓冲或卡顿或其他类似的情况，此类情况并BMostChat过错，BMostChat无需就此类情况向用户承担责任。且为了减少甚至避免上述情况的出现，从而进一步提升用户的服务体验，用户确认BMostChat可采取一系列技术手段对产品和服务进行优化。
3.10 用户知悉并同意，BMostChat提供的产品与服务需接入互联网方可使用，因此用户需自行承担使用产品与服务过程中所产生的上行和下行的网络通信流量费用，上述费用将由网络运营商收取。用户亦可通过产品的设置页面对网络使用信息进行相关设置。
3.11 用户在使用 BMostChat 的产品与/或服务时，应遵守适用的法律法规，包括但不限于数据保护、版权、安全、网络使用、消费者保护、反洗钱、反腐败、竞争法、刑法等要求，并确保不违反所在国家/地区及中华人民共和国的任何法律，承担由此产生的法律责任。BMostChat 有权在发现用户违反相关法律或本协议时，采取适当措施，包括暂停或终止服务、封禁账户等，并要求用户承担因此产生的法律责任。BMostChat 禁止用户利用其提供的产品和服务从事以下行为：
- 3.11.1 制作、上传、复制、传送、传播包含任何反对宪法所确定的基本原则、危害国家安全、泄露国家秘密、颠覆国家政权、破坏国家统一、破坏民族团结、损害国家荣誉和利益、煽动民族仇恨、民族歧视、破坏民族团结、破坏国家宗教政策、宣扬邪教和封建迷信、淫秽、色情、赌博、暴力、凶杀、恐怖或者教唆犯罪、侮辱或者诽谤他人，侵害他人合法权益的等法律法规禁止的内容或其他令人反感的内容，包括但不限于资讯、资料、文字、软件、音乐、照片、图形或其他资料；
- 3.11.2 以任何方式危害未成年人；
- 3.11.3 冒充任何人或任何有关机构；
- 3.11.4 伪造标题或以其他方式操控识别资料，使人误以为该内容为BMostChat所传送；
- 3.11.5 将无权传送的内容（例如内部资料、机密资料）进行上载、张贴、发送电子邮件或以其他方式传送；
- 3.11.6 将侵犯任何人的专利、商标、著作权、商业秘密或其他专属权利之内容加以上载、张贴、发送电子邮件或以其他方式传送；
- 3.11.7 将广告函件、促销资料、"垃圾邮件"等，加以上载、张贴、发送电子邮件或以其他方式传送。供前述目的使用的专用区域除外；
- 3.11.8 跟踪或以其他方式骚扰他人，非法侵入他人网络、干扰他人网络正常功能、窃取网络数据等危害网络安全的行为；
- 3.11.9 向他人提供专门用于从事侵入网络、干扰网络正常功能及防护措施窃取网络数据等危害网络安全活动的程序、工具，或明知他人从事危害网络安全的活动的，为其提供技术支持、广告推广、支付结算等帮助的行为；
- 3.11.10 利用BMostChat提供的服务设立用于实施诈骗、传授犯罪方法，制作或者销售违禁物品、管制物品等违法犯罪活动的网站、通讯群组，或利用BMostChat的网络发布涉及实施诈骗，制作或者销售违禁物品，管制物品以及其他违法犯罪活动的信息；
- 3.11.11 将有关干扰、破坏或限制任何计算机软件、硬件或通讯设备功能的软件病毒或其他计算机代码、档案和程序资料，加以上载、张贴、发送电子邮件或以其他方式传送；
- 3.11.12 干扰或破坏BMostChat服务或与BMostChat服务相连的服务器和网络；
- 3.11.13 故意或非故意违反任何相关的法律、法规、规章、条例等其他具有法律效力的规范；
- 3.11.14 用户需保证其上传内容不得违反其所在国家/地区以及中华人民共和国的法律法规，包括但不限于中华人民共和国《互联网视听节目服务管理规定》（广电总局、信息产业部令第56号令）等相关规定。其上传内容应符合法律、行政法规及部门规章，并且不得包含以下内容：
- （一）反对宪法确定的基本原则的；
- （二）危害国家统一、主权和领土完整的；
- （三）泄露国家秘密、危害国家安全或者损害国家荣誉和利益的；
- （四）煽动民族仇恨、民族歧视，破坏民族团结，或者侵害民族风俗、习惯的；
- （五）宣扬邪教、迷信的；
- （六）扰乱社会秩序，破坏社会稳定的；
- （七）诱导未成年人违法犯罪和渲染暴力、色情、赌博、恐怖活动的；
- （八）侮辱或者诽谤他人，侵害公民个人隐私等他人合法权益的；
- （九）危害社会公德，损害民族优秀文化传统的；
- （十）有关法律、行政法规和国家规定禁止的其他内容。
如用户提供的上传内容含有以上违反政策法律法规的信息或者内容的，由用户直接承担由此导致的一切不利后果，如因此给BMostChat造成不利后果的，用户应负责消除影响，并且赔偿因此导致的一切损失。
- 3.11.15 未经BMostChat事先明确书面许可，以任何方式（包括但不限于机器人软件、蜘蛛软件、爬虫软件等任何自动程序、脚本、软件）和任何理由自行或委托他人、协助他人获取平台的服务、内容、数据；
- 3.11.16 未经BMostChat事先明确授权，以商业性或其他非个人使用等目的为自己或他人获取、使用BMostChat的产品与/或服务；
- 3.11.17 未经BMostChat明确授权，采用收费或免费的方式，在任何公开场合全部或部分展示BMostChat的服务内容（但如您的上述行为不构成侵权的除外）；
- 3.11.18 通过不正当手段或以违反诚实信用原则的方式（如利用规则漏洞、利用系统漏洞、滥用会员身份、黑色产业、投机等违背BMostChat提供服务/举办活动的初衷的方式）进行任何违法或不正当的活动；
- 3.11.19 通过侵犯他人合法权益的方式使用BMostChat的产品与/或服务；
- 3.11.20 其他未经过BMostChat明示授权许可或违反本协议、法律法规或监管政策的行为；
3.12 用户使用BMostChat的产品与/或服务在BMostChat平台制作、上传、发布、传播符号、文字、图片、音频、视频等内容的，应保证其上传内容不违反中国大陆地区及使用当地的法律法规及相关规范性文件，亦不侵犯任何第三方的合法权益，否则导致的一切不利后果均由用户自行承担，造成BMostChat损失的，还应向BMostChat承担赔偿责任。对于相关权利人因用户违反本款约定向BMostChat主张权利的，BMostChat有权不通知上传用户直接删除、下线、屏蔽相关争议内容。
3.13 用户对其利用BMostChat服务制作、上传、发布、传播的符号、文字、图片、音频、视频等内容的行为，独立完整地承担法律责任，如造成BMostChat损失的，应向BMostChat承担赔偿责任。同时：
- 3.13.1 为了遵守相关法律法规、保护他人的合法权益、维护BMostChat的信誉及安全，BMostChat有权直接删除用户利用BMostChat产品与/或服务制作、上传、发布、传播的符号、文字、图片、音频、视频等内容，而无需事先通知用户；
- 3.13.2 BMostChat有权视情节严重程度对该用户做出封禁，永久禁止其利用BMostChat产品与/或服务制作、上传、发布、传播的符号、文字、图片、音频、视频等内容的处理；
- 3.13.3 BMostChat的后台记录有可能作为用户违反法律法规、违约、侵权的证据。BMostChat 有权封禁您的账户，永久禁止您使用 BMostChat 产品与服务创建、上传、发布和传播您的符号、文字、图片、音频、视频及其他内容；
3.14 用户应当保证，不会利用BMostChat服务或其衍生服务侵犯BMostChat以及他人的合法权益，禁止通过网络漏洞、恶意软件或其他非法手段破坏BMostChat的正常经营，窃取、盗用他人的账号及账号下财产等；禁止侵犯他人合法权益等。否则，BMostChat有权根据情节严重而对该用户及账号进行冻结、封停等处理。构成犯罪的，BMostChat有权移交有关部门处理。
3.15 用户可以向BMostChat提出咨询和获得BMostChat服务的合理技术支持，BMostChat的此项义务不应超过BMostChat的合理承受限度。
3.16 用户在享受BMostChat提供的其他服务时，除需遵守本协议约定的内容外，用户仍需分别遵守BMostChat在相应服务页面公布的需用户遵守的全部约定（上述协议名称在未来可能会因业务需要相应调整，具体以平台实际展示为准，协议名称变更不影响本条款效力）。
3.17 如您在BMostChat平台上使用第三方提供的产品或服务时，除遵守本协议约定外，还应遵守第三方的服务条款。
3.18 您知悉并同意，如您存在或BMostChat经独立判断后认为您存在任何违反国家法律法规或监管政策、违反本协议或有损BMostChat的声誉、利益的行为的，BMostChat有权独立决定采取以下一项或多项处理措施：
- 3.18.1 如本协议对此行为有单独条款约定处理方式的，按照该条款处理；
- 3.18.2 无需通知您而采取一种或多种措施制止您的行为及行为产生的后果，如删除/屏蔽相关链接或内容、限制/取消您的账号/账户使用权限等；
- 3.18.3 无需通知您而中断或终止部分或全部服务，且您已缴纳的相关服务费用（如有）将不予退还或获得任何形式的补偿/赔偿；
- 3.18.4 如您的行为使BMostChat遭受任何损失的，您应当承担全部损失赔偿责任并在BMostChat要求的时限内完成费用支付。
You must provide complete, true, accurate, legal, valid, and up-to-date personal information, when signing up for an account on BMostChat. Should the above information change, You should also timely update such information, and ensure the validity of such information. You must not falsely use others' identity or use others' email, phone number, etc. to sign up for the BMostChat account.
You can only sign up as BMostChat registered users through the official channel of BMostChat. BMostChat does not guarantee the legality and functionality of any BMostChat accounts obtained through other unofficial channels (including but not limited to purchasing, renting, borrowing, sharing, etc., as well as accounts obtained through malicious abuse or sabotage of BMostChat registration system). BMostChat may suspend, cancel, or confiscate such accounts without liability.
You guarantee that all information submitted in registration is true, and that your account name, avatar, and profile do not contain illegal or harmful information. BMostChat has the right to verify the above information, refuse registration in case of breach of such guarantee, and unilaterally rectify, clear, temporarily or permanently suspend, cancel, or confiscate such accounts without notice.
You must not sign up for any BMostChat account with malicious intent, as evidenced by means including but not limited to using invalid and unverified email, invalid mobile phone number, or using another person's identity. You must not use the BMostChat account to engage in illegal activities, violation, harassing, deceiving, defrauding other users, or in other activities banned by this agreement. BMostChat has the right to. At the same time, BMostChat has the right to temporarily or permanently suspend, cancel, or confiscate such accounts and report the matter to the proper authorities. Any losses arising therefrom shall be solely borne by you.
You acknowledge that the ownership of the BMostChat account belongs to BMostChat, and You only obtain the right to use the BMostChat account. You are responsible for all actions carried out under the account, and shall not give, lend, rent, lease, transfer, sell or share the BMostChat account, nor permit any party other than You to use it. Otherwise, BMostChat has the right to temporarily or permanently suspend this account at its sole discretion. In case of unauthorized use or possible compromise of your account, You should immediately notify BMostChat, or such unauthorized use might be deemed as operation from your own. In order to ensure the security of your account, BMostChat may periodically ask for verification of the users by methods, including but not limited to verification codes sent via SMS verification, or email authentication, etc. BMostChat may suspend your account and services upon reasonable suspicion that your account is compromised and may not be held liable for any losses or damages incurred as a result.
If You want to recover your account due to an error that could not be ascribed to BMostChat, You must follow the official guideline for account recovery, by providing legal, valid information/documentation. Should you fail in the account recovery process, You and BMostChat agree that BMostChat shall not be liable for the resulting losses and risks.
You acknowledge that in order to provide higher quality service to more users, BMostChat reserves the right to permanently suspend, deregister, or reclaim any account that remains inactive for six consecutive months, is obtained through illicit means, or violates this User Agreement.
You agree that BMostChat has the right to place commercial advertisements or any other type of commercial information in various ways during the services. You agree that BMostChat, after obtaining your consent, could send product/service promotions or other related business information to You through means chosen by you.
You acknowledge and agree that due to bandwidth and network connectivity issues, and no fault of BMostChat, You may encounter login failures, long buffering, lag, incomplete data synchronization, or other similar situations when using BMostChat. BMostChat is not responsible for such situations nor for the losses and damages resulting therefrom. You further agree that in order to improve user experience, BMostChat has the right to take further measures to optimize its products and services.
You acknowledge and agree that the products and services provided by BMostChat will utilize your device's processor, bandwidth, and other resources and may incur data traffic charges. You are solely responsible for consulting your service provider for relevant fee information and for bearing all associated costs.
Users must comply with applicable laws and regulations while using BMostChat's products and/or services, including but not limited to data protection, copyright, security, internet usage, consumer protection, anti-money laundering, anti-corruption, competition law, criminal law, and other requirements. Users must ensure that their actions do not violate any laws in their country/region or in the People's Republic of China and will bear any legal responsibilities arising from such violations. BMostChat has the right to take appropriate measures, including suspending or terminating services, banning accounts, etc., if it finds that the user has violated relevant laws or this agreement, and to hold the user accountable for the resulting legal responsibilities. BMostChat prohibits users from using its products and services to engage in the following behaviors:
- inciting hatred, discrimination in terms of color, race, national origin, religion and gender; promoting cults, superstitions, obscenity, pornography, gambling, violence, murder, terrorism; insulting and defaming other people; infringing upon the rights of other people. Contents prohibited by laws and regulations include but are not limited to news, files, documents, software, music, photos, shapes and other forms;
- Harming underage minors in any way;
- Impersonating any person or organization;
- Forging of titles or other manipulation, causing people to mistakenly believe that the content is transmitted by BMostChat;
- Uploading, posting, or otherwise transmitting content without proper authorization from the rights-holder;
- Uploading, posting, or otherwise transmitting content that infringes upon any third party's patents, trademarks, copyrights, trade secrets, or other exclusive rights;
- Uploading, posting, or otherwise transmitting advertisement letters, promotional materials, except for in space dedicated for such purposes;
- Stalking or harassing other users; hacking into other user's networks, impairing their regular functions, stealing network data, and other behaviors that endanger network security;
- Providing programs and tools specifically designed to engage in activities that endanger network security, such as hacking into other user's networks, impairing its regular functions, stealing network data; or knowingly providing technical support, promotion, and payment assistance to others who engage in such activities that endanger network security;
- Establishing websites or groups to impart crime knowledge and methods, produce and distribute prohibited items, commit fraud, and facilitate other illegal and criminal activities via BMostChat services;
- Uploading, posting, or otherwise transmitting viruses, codes, and program files that impair, damage or restrict the functions of the software and hardware of other user's devices;
- Impairing BMostChat services or the servers and networks connected to such services;
- Intentionally or unintentionally violating any applicable laws, regulations and rules, or other legally binding norms;
- Users must ensure that the content they upload does not violate the laws and regulations of their country/region, as well as those of the People's Republic of China, including but not limited to the "Regulations on the Administration of Internet Audio-Visual Program Services" of the People's Republic of China (State Administration of Radio, Film and Television, Ministry of Information Industry Order No. 56) and other relevant regulations. The uploaded content must comply with laws, administrative regulations, and departmental rules, and must not contain the following:
(1) Opposing the basic principles established by the Constitution;
(2) Harming national unity, sovereignty, and territorial integrity;
(3) Leaking national secrets, endangering national security, or damaging national honor and interests;
(4) Inciting ethnic hatred, discrimination, undermining ethnic unity, or infringing on ethnic customs and habits;
(5) Advocating cults and superstitions;
(6) Disrupting social order and disrupting social stability;
(7) Inducing minors to commit illegal crimes and portraying violent, pornographic, gambling, or terrorist activities;
(8) Insult or slander others, infringe upon the legitimate rights and interests of citizens' personal privacy and other individuals;
(9) Harming social morality and damaging the excellent cultural traditions of the nation;
(10) Other contents prohibited by relevant laws, administrative regulations, and national regulations
If the uploaded content provided by the user contains information or content that violates policies, laws, and regulations, the user shall directly bear all adverse consequences caused by the uploaded content. If any adverse consequences are caused to the company, the user shall be responsible for eliminating the impact and compensating for all losses caused as a result.
Without the prior written consent of BMostChat, obtaining the services, content, and data of the BMostChat Platforms by any means (including but not limited to robot software, spider software, crawler software, and any other automatic programs, scripts, software) or for any reason; or entrusting others with or assisting others in, obtaining the services, content, and data of the BMostChat Platforms;
Without the prior written consent of BMostChat, obtaining and using the products and services of BMostChat for non-personal purposes for yourself or any other person;
Without the explicit authorization of BMostChat, using paid or free methods to display all or part of BMostChat's services in any public domain (unless your actions do not constitute infringement);
Engaging in any unlawful or improper activities through improper means or in violation of good faith principles (such as exploiting loopholes in rules, system vulnerabilities, abusing membership status, black market activity, speculation, or any activities contrary to the intended purpose of services or events provided by BMostChat);
Using BMostChat's products and/or services in a manner that infringes upon the lawful rights of others;
Engaging in any behavior that has not been explicitly authorized by BMostChat or violates this agreement, laws, regulations, or regulatory policies;
When users create, upload, publish, or distribute symbols, text, images, audio, videos, or other content on the BMostChat platform, they must ensure that the uploaded content does not violate the laws, regulations, or normative documents of the People’s Republic of China or the local jurisdiction in which the service is used, nor infringe upon any third party’s legitimate rights. Any adverse consequences arising from such violations will be borne by the user, and if BMostChat suffers any losses, the user shall be liable for compensation. If relevant rights holders assert claims against BMostChat due to the user’s violation of this provision, BMostChat has the right to delete, remove, or block the disputed content without notifying the user.
Users are solely responsible for the legal consequences of creating, uploading, publishing, or distributing symbols, text, images, audio, videos, or other content using BMostChat's services. If BMostChat suffers any loss, the user must compensate BMostChat. Meanwhile:
- In order to comply with relevant laws and regulations, protect the legitimate rights of others, and maintain the reputation and security of BMostChat, BMostChat has the right to delete the content created, uploaded, published, or distributed by the user using BMostChat products and/or services without prior notice to the user;
- BMostChat has the right to ban the user, permanently prohibiting them from creating, uploading, publishing, or distributing content through BMostChat products and/or services, depending on the severity of the situation;
- BMostChat’s backend records may serve as evidence for any legal violations, breaches, or infringements by the user.BMostChat has the right to ban your account, permanently prohibit your use of BMostChat products and services to create, upload, release and publish your symbols, texts, images, audios, videos, and other content;
- Users must ensure that they do not use BMostChat services or related services to infringe upon the legitimate rights of BMostChat or others. Users are prohibited from using network vulnerabilities, malicious software, or other illegal methods to damage BMostChat's normal operations, steal or misuse others' accounts or assets under those accounts, or infringe upon others’ rights. Otherwise, BMostChat has the right to freeze or suspend the user’s account based on the severity of the situation. If the action constitutes a criminal offense, BMostChat has the right to report it to the relevant authorities.
- Users may consult BMostChat for reasonable technical support and guidance on using BMostChat services. This obligation does not extend beyond BMostChat's reasonable capacity.
- When using other services provided by BMostChat, in addition to complying with the terms of this agreement, users must also adhere to all other terms published on the corresponding service pages of BMostChat (the names of these agreements may change in the future due to business needs, with such changes to be displayed on the platform; changes in agreement names do not affect the validity of this provision).
- When you use third-party products or services on the BMostChat platform, you must comply with the terms of this agreement and also adhere to the third-party's terms of service.
- You acknowledge and agree that if BMostChat reasonably believes that you have violated any applicable laws, regulations or regulatory policies, violated this Agreement, or damaged the reputation or interests of BMostChat. BMostChat has the right to independently and unilaterally to take one or more of the following measures:
- if there is a separate clause in this Agreement regarding the handling of your violation, it shall be handled in accordance with that clause;
- delete/block relevant links or content, restrict/cancel your account without prior notification, etc;
- suspend or terminate part or all services to you without prior notification, and retain service fees you have paid (if you have) with no refunds or compensation
- start legal actions against You for any losses and damages BMostChat suffered; you shall bear full liability for compensation and complete the payment within the time limit required by BMostChat or the proper authorities.
4.Upload and Share User Content
Unless there is evidence to the contrary, You shall be deemed as the rights-holder or person with authorization of such content, if You upload, publish, or transmit content using the BMostChat Platforms services. Unless stipulated otherwise by both parties, your publication, dissemination, and sharing of images, texts, audios, videos, and other forms of content represent that You have the right and agree to permanently, irrevocably, and freely grant BMostChat worldwide the right to exercise all copyrights over the content, except for the rights belonging to You, the copyright owner. That is, BMostChat can exercise: 1) the right to use, release, disseminate, copy, modify, adapt, publish, translate and other rights to the above content, and create derivative works, disseminate, perform and display them; 2) the right to incorporate all or part of the content into any other form of work, media, or technology; 3) the right to conduct commercial development of your content; 4) the right to provide download, video-on-demand, and data transmission on computer terminals, mobile communication terminals (including but not limited to portable communication devices such as cell phones and smart tablets), handheld digital audio and video playback devices, television receiving devices (analog signal receiving devices, digital signal receiving devices, digital TV, IPTV, playback devices with internet access function, etc.), and mobile video services (including but not limited to SMS, MMS, WAP, IVR, Streaming, 3G, 4G, mobile video and other wireless services), as well as related promotional and promotional services.
5. User Personal Information Protection
Personal information refers to various types of information recorded electronically or in other fashions, that can independently or in combination with other information, ascertain the identity of a specific natural person or reflect the activities of such a specific natural person. When you download, install, start, browse, register, log in, and use the products and services of BMostChat, BMostChat will process and protect your personal information in accordance with the provisions of the BMostChat Privacy Policy published on the BMostChat Platforms. Therefore, BMostChat hopes that you can carefully read and fully understand the full text of the BMostChat Privacy Policy, and if necessary, follow the guidelines of the BMostChat Privacy Policy, in order to make appropriate choices.
You should carefully read and fully understand the BMostChat Privacy Policy before using the products and services of BMostChat. If You do not agree with the Policy, it may cause disruption of the products and services and therefore failure to achieve your purpose as the products and services intended. You should immediately stop accessing/using the products and services of BMostChat upon your disagreement. By using or continuing to use the products and services provided by BMostChat, you fully understand and agree to the entire content of the BMostChat Privacy Policy (including updated versions).
BMostChat understands the importance of personal information, therefore dedicates to protect your privacy and personal information, and treats and processes your personal information with a high degree of prudence. For more information regarding rules of processing and protecting personal information, as well as your control over the personal information, please refer to the full text of the BMostChat Privacy Policy on BMostChat Platforms.
If You have any questions (including inquiries, complaints, etc.) regarding the BMostChat Privacy Policy or your personal information, you can contact BMostChat through the BMostChat Privacy Policy or the contact information listed at the end of this Agreement.
6. Intellectual Property
Under the protection of international copyright conventions, the Copyright Law of China and in your jurisdiction, the Patent Law of China and in your jurisdiction, and other applicable laws and regulations on intellectual property, all intellectual property rights of the products and services of BMostChat and BMostChat's software, interface, interaction, and other elements, such as logo, trademark, sign, graphics, text, voice, audio, video, portrait, picture, technology, materials, etc., belong to BMostChat. The word "intellectual property" includes any and all rights, any and all other ownership rights, and any and all applications, updates, extensions and recoveries thereof under the patent law, copyright law, trademark law, anti-unfair competition law and other laws.
You shall not modify, adapt, translate the software, technology, materials, etc. used in BMostChat services, or create derivative works related to it. You shall not try to obtain BMostChat's source code through reverse engineering, decompilation, disassembly, or other similar actions. BMostChat reserves its rights to pursue legal actions against such actions and may hold the actor liable according to the laws.
You can only use the products and services provided by BMostChat within the scope of this Agreement, or with the express authorization of BMostChat. Without the prior written consent of BMostChat, You shall not modify, copy, disseminate, transmit, distribute, transfer, sell BMostChat products, services or content of such products or services. Also, You shall not create or produce derivative products or derivative works related to these contents, whether for profit or non-profit purposes. You shall bear all responsibilities for losses and damages caused to BMostChat or other persons as a result of your non-compliance with this term.
Without the prior written consent of BMostChat, You shall not delete, conceal, or change the copyright statement, trademark, or other rights statement/label of BMostChat. All design patterns and other patterns, products and services, including their names are trademarks and logos of BMostChat. Without the prior written consent of BMostChat, You are not allowed to use or copy the trademarks and logos for other purposes. Also, You are not allowed to crack, modify, reverse operate, tamper with, or otherwise disrupt any security measures or technologies used to protect BMostChat products and services.
Without the prior written consent of BMostChat, You are not allowed to modify, rent, distribute, forward or derive works from the content transmitted through BMostChat products and services. BMostChat holds the full intellectual property rights to its self-made content and other exclusive content obtained through authorization. Also, without the permission of BMostChat, no organizations or individuals may privately forward, disseminate, or provide viewing services, or engage in any other infringement of BMostChat's intellectual property rights. BMostChat reserves its rights to pursue legal actions against such actions and may hold the actor liable according to the laws.
You may need to download BMostChat software before using its products and services. For this software, BMostChat only grants You a revocable, limited, non-transferable, and non-exclusive license to use the software. Unless explicitly authorized in writing by BMostChat in advance, You may only use the software, the products and services for non-commercial purposes of accessing/browsing the products and services.
The intellectual property rights owned by BMostChat shall not be transferred due to any user behavior.
7. Advertising, Third-Party Links
BMostChat reserves the right to associate or display advertisements or advertising links through relevant webpages, and its method and scope may be changed without notification to You. You are not allowed to modify, remove, or conceal these advertisements in any way.
7.2.Subject to compliance with the applicable Advertising Law of the People's Republic of China, BMostChat has the right to independently determine the form, duration, location, and content of advertising placement without intervention from any third party.
The products and services of BMostChat may provide links to other international internet websites or resources. BMostChat will fulfill relevant obligations to advertisers in accordance with legal provisions. However, You acknowledge and agree that these advertisers and advertising content are not controlled by BMostChat, that You should carefully determine the authenticity and reliability of advertising information, and that You are responsible for your interaction and dispute resolution with the advertisers. Except as stipulated by the laws where the responsibilities are assumed by the advertisers, BMostChat does not assume any additional responsibilities, but will provide necessary assistance according to law.
8. Limitation of Liability
You understand and agree BMostChat provides its products and services as in conditions achievable with the current state of technology. BMostChat cannot guarantee the flawless and error-free status of the products and services it provides, and does not make any express or implied warranty for the products and services it provides, including but not limited to quality, stability, correctness, timeliness, completeness, coherence, safety, etc. However, BMostChat undertakes to continuously improve its service quality and level.
In order to improve your experience, ensure the safety of products and services, and facilitate the consistency of product/service functions, BMostChat may update the software. You should update the software to the latest version, otherwise BMostChat does not guarantee its functionality.
BMostChat does not guarantee any of the following matters (including but not limited to):
Notwithstanding all the testing that BMostChat Apps, due to the limitations of the technology itself, BMostChat cannot guarantee full compatibility with other software, hardware, and systems. If incompatibility occurs, You can report the situation to BMostChat for technical support. If the problem cannot be solved, You can choose to uninstall or stop using BMostChat and its services;
The use of BMostChat services involves Internet services, which may be affected by various unforeseen circumstances and factors. Force majeure, hacker attacks, system instability, network interruption, user shutdown, communication problems, and other reasons, may all contribute to the interruption or instability of BMostChat services. BMostChat does not guarantee your satisfaction when using the services at any given time;
Since the software provided by BMostChat can be downloaded and disseminated through the network, BMostChat cannot guarantee whether the software functions properly, or contains viruses, Trojan programs and other hacker software, if you obtain the Software or any installation program bearing the same name as BMostChat from any unauthorized third party. BMostChat shall not be liable for any direct or indirect losses or damages incurred as the result of such download
BMostChat does not guarantee the safety, reliability, timeliness, and performance of the products and services of BMostChat;
BMostChat does not guarantee that any of its products, services, or other materials provided meet your expectations.
You shall bear the risk of using any data downloaded or obtained through BMostChat services, and bear full responsibility for the damages to your computer system or loss of data caused by such use.
BMostChat shall not be liable for any direct, indirect, incidental, derivative or punitive damages for any loss in profit, goodwill, data, files, or other tangible or intangible assets caused by the following reasons:
Whether You are able or unable to use BMostChat's products and services;
Any products, materials, or services purchased or obtained through BMostChat;
Unauthorized use or modification of your information by a third party;
Other matters related to BMostChat and its products and services.
You should properly safe keep your account and password, strengthen password security, and avoid account leak or theft. BMostChat shall not be liable for loss of account or loss of assets caused by the leak or theft of your account. If You lose your account or assets in the account due to telecommunication problems, network issues or computer malfunctions, system instability, force majeure (such as server downtime) or other reasons not related to BMostChat, BMostChat shall not be liable for compensation or indemnity arising therefrom.
If You lose your account or assets in the account due to lack of ID authentication or untrue authentication information, therefore making the account not retrievable, BMostChat shall not bear any responsibility in such circumstances.
You understand and agree to freely choose to download and use the products and services of BMostChat, at your own risk, including but not limited to the risks arising from your behavior during the use of the products and services, as well as any risks arising from consequences of your use of the products and services. If your computer system or terminal device is damaged or its data is lost due to downloading or using BMostChat and its products and services, BMostChat shall not be liable for compensation or indemnity arising therefrom.
You acknowledge and agree that BMostChat, at its sole discretion, has the right to modify, interrupt, suspend, or terminate products and services at any time due to operational needs, business changes/adjustments, and technical improvement, without notification to You. BMostChat's exercise of this right does not give rise to assumption of any liability for compensation to you or any third party, unless otherwise specified by the laws and regulations, or agreed by both parties.
BMostChat, based on its own judgment, has the right to delete, block, or disconnect any content that violates or is suspected of violating Chinese and other applicable laws, or this Agreement, depending on the circumstances; to cease providing services to You, delete or cancel the account; and to report and refer such matter to the proper authorities in accordance with Chinese and other applicable laws and regulations.
BMostChat only bears the direct responsibility explicitly specified in this Agreement. Unless otherwise specified in this Agreement or by You and BMostChat, in any case, the total liability of BMostChat for compensation or indemnity under this agreement shall not exceed the total service fee charged by BMostChat for providing its products and services to you.
Regardless of foreseeability and the type of behavior, BMostChat is not responsible for special, indirect, punitive, sudden, or causal damages or any other damages (including but not limited to loss of profits or interest, business interruption, loss of information) caused by any reason.
9. Change, Interruption and Termination of Services
BMostChat has the right to temporarily or permanently change or terminate the products and services of BMostChat in part or in entirety, based on the business judgment. Regardless of whether You are notified, BMostChat shall not be liable for the breach of contract to You or any third party for the change or termination of the products and services of BMostChat.
Except for the situations in Article 9.1 above, BMostChat has the right to suspend or terminate the services in the following situations:
At your own request;
BMostChat reasonably believes that you have engaged in any behavior that violates applicable laws, regulations or regulatory policies; violates this Agreement; or harms the rights and interests of BMostChat;
In accordance with the laws, regulations, regulatory policies, or the requirements of the proper authorities;
In need of maintaining accounts and system security in emergency situations;
Force majeure (considering the special nature of the Internet, force majeure also includes hacker attacks, significant impacts caused by technological adjustments in electric power/telecommunications departments, temporary shutdowns caused by government regulations, virus attacks, and other situations that affect the normal operation of the Internet);
Other irresistible circumstances.
When the termination mentioned in Article 9.2 occurs, both You and BMostChat agree on the following handling method:
The accrued but unused rights under your account will be automatically cleared and not be discounted;
If You have ongoing transactions on the BMostChat Platforms, BMostChat will handle them reasonably according to the situation at that time;
Unless otherwise specified by the laws and regulations or clarified by BMostChat, the relevant fees already collected by BMostChat shall not be refunded;
In case of termination due to your breach of this Agreement, BMostChat has the right to hold You liable for breach of contract depending on the situation;
Unless otherwise specified by the laws and regulations or clarified by BMostChat, BMostChat stands free of liabilities to you or any third party.
10. Account Cancellation
You have the right to cancel your account at any time you deem fit. You can cancel online, contact BMostChat customer service, or cancel your account through other methods made available by BMostChat. Once You cancel your account, You will not be able to use the full range of products and services provided on BMostChat, and will automatically forfeit your existing rights. Furthermore, account cancellation is irreversible. Therefore, please proceed with caution and ensure that you have completed all pending transactions, resolved any disputes, and fulfilled all legal obligations. If we find that you have pending transactions, unresolved disputes, or other circumstances that make it unsuitable to cancel your account, we have the right to refuse your cancellation requests until the aforementioned events cease to exist. Unless otherwise specified by the laws and regulations, after the account is cancelled, BMostChat will stop providing You with all products and services. All content, information, data and records that You generated under BMostChat will be deleted or anonymized.
If You still insist on canceling your BMostChat account after careful consideration, You can submit a cancellation application to BMostChat on the relevant page, or follow the instructions provided to you. You agree and acknowledge that your successful account cancellation only signifies the termination of your service relationship with us, but does not mean that the platform waives its right to hold you accountable and claim compensation. If the platform subsequently discovers any violations in your account registration and use, it still has the right to hold you accountable and claim compensation.
11. Age Restriction and Minors
Applicable Age Thresholds:
EU/EEA: You may use the Services only if you are at least 16 years old.We do not provide the Services to individuals under 16, nor do we knowingly collect their personal information.
Other Countries/Regions: The minimum age to use the Services is 13.We do not provide the Services to individuals under 13, nor do we knowingly collect their personal information.
Higher Local Standards Prevail: If the laws of your location set a higher or stricter minimum age or require parental/guardian consent, that higher/stricter standard applies(e.g., India: under 18; Republic of Korea: under 14; Mainland China: special protections for children under 14).
BMostChat takes the protection of minors seriously and complies with applicable laws and regulations, including but not limited to the Children’s Online Privacy Protection Act (“COPPA”) and the relevant laws of your country/region as well as the People's Republic of China. If you are a minor under the legal age of majority, you must review this Agreement with a parent or legal guardian. You may only access or use BMostChat's products and services after obtaining explicit written consent from your parent or legal guardian.
Parents and legal guardians are responsible for supervising minors' use of the services and for instructing them on appropriate online behavior and safety. BMostChat does not knowingly permit minors to make purchases or engage in paid activities without verifiable parental consent. Any transaction involving payment must be carried out by the parent or legal guardian, or with their express authorization. Minors are prohibited from using any paid features or Services without such consent.
BMostChat encourages minors to use the services responsibly—to engage in positive, age-appropriate, and educational online activities; to recognize the difference between online and real-world interactions; and to avoid excessive use of digital media that may interfere with their education, health, or daily routines.
BMostChat will not knowingly collect, retain, or use any personal information of children under the legal age (e.g., under 13 years old in the United States, under 16 years old in the EU/EEA, or as defined by other relevant local laws) without verifiable parental consent. BMostChat complies with all applicable laws and regulations of the country/region to ensure that personal information is not collected or processed when minors use the service. When minors use the service, BMostChat will process their personal information in accordance with applicable laws and the privacy policy published on the platform. Parents and guardians may review, modify, or request the deletion of their child’s personal information through the channels specified in the privacy policy. For the protection of minors' privacy, BMostChat will strictly follow the methods and procedures outlined in the platform’s published BMostChat Privacy Policy.
Child Safety
BMostChat has zero tolerance for any forms of child sexual exploitation and removes certain media depicting physical child abuse to prevent the normalization of violence against children. BMostChat's Child Safety policy is designed to protect minors from sexual and physical abuse, as well as psychological harm that may result from sharing such content. With this principle in mind, Child Safety content is any content that contains Child Sexual Exploitation, Child Physical Abuse media.
Child Sexual Exploitation
BMostChat has zero tolerance towards any material that features or promotes child sexual exploitation. This may include real media, text, illustrated, or computer-generated media - including generative AI media. Regardless of the intent, anyone viewing, sharing, linking, or engaging with any kind of child sexual exploitation material contributes to the re-victimization of the depicted children and puts children at an extreme risk of being harmed. This also applies to content that may further contribute to victimization of children through the promotion or glorification of child sexual exploitation.
In the majority of cases, users will be immediately and permanently banned from any BMostChat Platforms. Additionally, when BMostChat is made aware of content depicting or promoting child sexual exploitation, including links to third party sites where this content can be accessed, the accounts sharing this content will be reported to the proper authorities, including but are not limited to National Center for Missing & Exploited Children (NCMEC). For certain violations, BMostChat may instead require post removal. For example, BMostChat may ask someone to remove the violating content. Subsequent violations may lead to account suspension or cancellation.
Child Physical Abuse
To prevent the re-victimization or normalization of violence against children, we will remove most instances of media depicting physical child abuse, even if shared to raise awareness or express outrage. When assessing the best course of action to take, we consider: whether the child is nude, partially clothed, or fully clothed; the severity of harm the child is experiencing; and whether the media was shared with abusive, non-abusive, or newsworthy context.
For violations of our Physical Child Abuse policy, we may: make the content less visible on BMostChat by: applying a content warning; or requiring post removal. For example, BMostChat may ask someone to remove the violating content and suspend the account for a period of read-only time before it can post again. Subsequent violations may lead to account suspension. If an account appears to be to engage in the types of behavior prohibited above, BMostChat will confiscate and delete this account immediately.
12. Notification
All notifications under this Agreement can be sent through webpage announcements, emails, mobile text messages, regular mail, or other common types of transmission. Such notices shall be deemed to have been delivered to You on the date of sending.

14.Miscellaneous
This Agreement is executed in Longgang District, Shenzhen City, Guangdong Province, the People's Republic of China.
The interpretation and dispute resolution of this Agreement shall be governed by the laws of the mainland of the People's Republic of China.
Any dispute arising from or in connection with this Agreement shall be resolved through friendly negotiations between the Parties. Should such negotiations fail, you agree to submit the dispute to the competent people's court in the place of execution of this Agreement.
The headings of the clauses herein are for convenience of reference only and shall not be used to interpret the provisions hereof.
Both Parties agree that for the purpose of dispute resolution, the latest version of the "BMostChat User Service Agreement" consented by you shall prevail.
If any provision of this Agreement is held invalid or unenforceable for any reason, the remaining provisions shall remain in full force and effect and continue to be binding upon the Parties.
This Agreement may be provided in multiple languages, including Chinese and English. If there is any conflict or discrepancy between the Chinese version and versions in other languages, the Chinese version shall prevail.
